Terms and conditions

1 Contract

1.1 The contract is for a short-term holiday letting and is made between the Client and Stately Holiday Homes (SHH) acting as agent for the Owner.

1.2 The contract will be entered into when SHH issues the confirmation of the Booking by letter, fax or email.

1.3 The Client signs the Booking form on behalf of himself and all members of his party and this is taken as confirmation of his and his party’s understanding and acceptance of these conditions.

1.4 The contract will be subject to the following conditions.

2 Payment

2.1 A deposit of 20% (unless otherwise stated) of the rental fee (‘Rent’) is payable in order to confirm the Booking, if the Booking is made more than 62 days before the start of the holiday week(s) and the balance is payable 62 days before the commencement of the holiday week(s). 2.2 If the Client does not pay the balance of the Rent by 2 weeks after the due date the contract shall be deemed to be cancelled by the Client.

2.3 In the case of Bookings made less than 62 days before the commencement of the holiday week(s) the Rent is payable in full on Booking. Full payment must be made by credit or debit card. Please note that cheques are not accepted for payment within 62 days of the commencement of your holiday.

2.4 All payments shall be made to SHH at such address as it designates (on the Booking form or otherwise).

3 Credit Cards

3.1 A charge of 1.4% shall be made for payments by credit card except as otherwise agreed by SHH.

4 Cancellation

4.1 Any cancellation made by the Client for whatever reason shall be in writing and addressed to SHH at its designated address.

4.2 The following charges are payable in the event of cancellation of a Booking:

5 Cancellation Insurance

5.1 SHH strongly recommends the Client to take out cancellation insurance to protect against the cancellation charges. SHH can provide you with suitable insurance cover. A leaflet will be enclosed with the holiday confirmation.

6 Non-availability

6.1 In the unlikely event that the Property becomes unavailable following confirmation of the Booking or changes are necessary to the Booking for reasons outside the control of SHH or the Owner, SHH undertakes to notify the Client as soon as reasonably possible and reserves the right to arrange alternative accommodation of a similar type and standard in a similar location for the holiday week(s) and to transfer the Booking accordingly, with appropriate financial adjustment (by way of allowance to or additional by the Client) to allow for any difference in rent.

6.2 If it is not possible to arrange alternative accommodation or if the Client does not wish to transfer the Booking SHH will have the right to cancel the Booking and refund to the Client all monies paid to it.

6.3 Provided that SHH shall comply with its obligations under this paragraph neither it nor the Owner shall have any further obligation or liability for non-availability, changes or cancellation as referred to in this condition.

7 VAT

7.1 The Rent is VAT inclusive (where applicable).

8 Letting Period

8.1 Unless otherwise notified the letting commences at 4.00 pm on the day of arrival and ends at 10.00 am on the day of departure.

9 Number of Occupants

9.1 The number of persons occupying the Property must not exceed the maximum number specified in SHH’s information. SHH reserves the right to refuse entry to the Property by the Client and his entire party if this requirement is not observed.

10 Complaints

10.1 Any complaints during the period of occupation must be notified promptly to SHH.

10.2 Any serious problems must be promptly confirmed in writing.

11 Care of the Property

11.1 The Client shall take reasonable and proper care of the Property and its contents and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the holiday week(s) as at the beginning, with all of the washing-up completed.

11.2 The Client is liable to reimburse SHH and/or the Owner on demand for the costs of replacement, repair or extra cleaning where he is in breach of his obligations under.

11.1 or any breakages or damage caused during the period of occupation.

12 Pets

12.1 Dogs are only permitted in the Property where expressly agreed.

12.2 Where dogs are permitted they must be under proper control at all times and the Client will be required to pay locally an additional fee of between £15 and £25 per dog, depending on location.

12.3 No pets other than dogs are permitted.

13 Insurance of Belongings

13.1 The Client shall be responsible for insuring his own possessions while they are on or in the Property.

14 Non-Liability

14.1 SHH, its employees and agents shall have no liability to the Client or third parties for any loss or damage arising from breach of contract, negligence, misrepresentation or otherwise.

15 Verbal information

15.1 SHH does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its servants or agents.

16 Right of Entry

16.1 SHH and/or the Owner or the Owner’s representative shall have a right of entry to the Property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance but (except in case of emergency) shall endeavour to make a prior arrangement with the Client.
